This website's access and usage are subject to acceptance of the terms and conditions below. In addition, any terms and conditions and rules and regulations our travel suppliers require you also accept when booking.

Welcome to SkyMedTravel.com. Please read the following Terms of Use (the "Terms") carefully. By using the Site and booking via any service directly or indirectly via any device including offline, online, telephone, email, etc., other than to read these Terms for the first time, you agree that the Terms will govern your use of the Site. SkyMed Travel reserves the right to change these Terms from time to time. Therefore, please refer to this Site periodically for any changes.

Site Usage and Ticket Purchase

In those situations in which a supplier defaults before providing services, you may pursue any recourse against the Supplier for a refund, which may be permitted by law or statute. SkyMed Travel warrants that it allows for the highest standards of service in the trade and will use appropriate care in selecting suppliers but cannot accept any responsibility from such default.

SKYMED TRAVEL and any of its affiliates assumes no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers; (3) any wrongful or negligent acts or omissions on the part of any other party not under SKYMED TRAVEL and any of its affiliates control; and (4) any Supplier price drop after your travel arrangements have been confirmed, paid in full, or ticketed. You hereby release SKYMED TRAVEL and any of its affiliates from all claims arising from any problem covered in this paragraph.


Travel arrangements involving airline and cruise components are subject to supplemental price increases that may be imposed by the Supplier and or government after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and that you may be bound by those contracts regardless of whether you receive notice of their terms. SkyMed Travel acts as a service bureau that provides value-added services to consumers. SkyMed Travel has no control over and assumes no liability for the actions of the suppliers from whom it obtains Travel products.

SkyMed Travel and the affiliates do not guarantee, endorse, validate, or promote other advertiser products and services advertised on this website.

You warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement and use the Site under all terms and conditions herein. You agree to be financially responsible for using the Site, including the use of your account by others. You are responsible for any bookings made by persons under your direction or control. You also warrant that all information supplied by you or on your behalf or by members of your household when using the Site is true and accurate. Further, you also confirm that any traveler will not make an unaccompanied minor. Without limitation, any exploratory, false, or fraudulent reservation or any reservation in anticipation of demand is prohibited. You agree that the travel services reservations facilities of the Site shall be used only to make legitimate reservations or purchases for you or for another person for whom you are legally authorized to act. You understand that overuse or abuse of the travel services reservation facilities of the Site may result in being denied further access to such facilities. It is your responsibility to maintain the secrecy of your membership details.

All offers, prices, and conditions of sale may be subject to:

  • change without notice

  • advance purchase, eligibility, seating, or other limitations

  • travel days, dates, minimum or maximum stays, holidays, seasons, blackout dates, stopovers, and waitlist restrictions

  • reservation validation limitations (if any extension permitted, penalties/restrictions may apply); and/or other conditions/restrictions

  • Availability. Prices may be available but not available on the Site.

  • If your itinerary involves an ultimate destination or with stops in a country other than the country of departure, the provisions of a treaty known as the "Warsaw Convention" may apply to your entire trip, including any portion entirely within the country of origin or destination. The Warsaw Convention governs and may limit the liability of individual air carriers for death of or personal injury to passengers and loss of or damage to baggage.

Once airline tickets and any document are issued, there may be a penalty involved for refunds that could result in a 100% loss of funds plus service fees. We do not have control over printed prices on airline tickets/documents. Some airline tickets may have I.T. or B.T. (Bulk fare) printed on them, and some may have a specific value on them, which may be different (lower or higher) than the airfare collected. Discounts offered may vary depending on several factors, including Airlines utilized, class of service, destination, time of year (low, mid, or high season), advance notice provided, minimum stay requirements fulfilled, and flight load.


A reservation is not complete until paid in full and documents and tickets issued. To protect our customers, we verify with the credit/debit card company that the billing address and credit card verification number you provided to us are accurate and that your debit/charge is accepted. We reserve the right to request further documentation for reservations or refuse to accept any booking that our system may flag as suspicious. Until all such information is verified, all fares/prices are subject to change. We are not responsible for any transaction not fulfilled due to a declined credit/debit card payment. Nor are we responsible for any changes in fare/rate or additional charges that may occur during the credit card verification process. There could be times when the fare selected is not available when completing a booking. An approval code for the cost could appear on the credit card and block your available credit for a short period, as dictated by the bank/credit card company. Airfares are not guaranteed until electronic tickets are issued. Prices and fares that require a deposit are not guaranteed until the Supplier receives the deposit.

SKYMED TRAVEL and any of its affiliates have no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. For information concerning possible dangers at destinations, FARELINE, LLC DBA SKYMED TRAVEL recommends contacting the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov. For medical information, FARELINE, LLC DBA SKYMED TRAVEL recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel. You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s) and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). You hereby release FARELINE, LLC DBA SKYMED TRAVEL from all claims arising out of any problem covered in this paragraph. You agree that the courts in Maricopa County, Arizona, will be the exclusive jurisdiction for all claims brought by you. You hereby submit to the personal jurisdiction of those courts.


For your protection, we strongly recommend that you purchase trip cancellation/interruption and travel accident insurance. However, no representation or description of the insurance made on this Site or by our staff constitutes a binding assurance or promise about the insurance. We also strongly recommend that you use a credit card for your purchase so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased.



TRAVEL DOCUMENTS, VISAS, AND PASSPORTS

All individuals visiting any foreign country must travel with a Government Issued Passport Book valid for six months or longer than your intended travel time. It is the responsibility of each traveler to obtain and carry all required travel documentation, including but not limited to passports and visas, which meet the requirements of immigration and other government authorities at every destination and transit country. If you are traveling anywhere outside of the USA, including to Canada, the Caribbean, and Mexico, you need a valid passport to board an international flight, cruise, and enter another country, and to return to your country. Because documentation requirements vary country by country, we strongly recommend that you contact the applicable Consulate(s) for the latest updates for documentation and laws for entering your destination and transiting country/countries. Any fines, penalties, payments, or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. Travelers traveling within the USA must have federally recognized and valid government-issued photo IDs, such as a passport, an Enhanced Driver's License, a tribal-issued photo ID, or an HSPD​12 PIV card. A temporary driver's license is not an acceptable form of identification. However, depending on the State of departure or State of arrival, a passport may be required. For U.S. domestic travel, it is the travelers' responsibility to carry the proper valid identification as set out in by Transport Security Information requirements found here, https://www.tsa.gov/travel/security-screening/identification , non-US citizens may require additional documentation.
A child traveling with one parent or someone who is not a parent or legal guardian or a group will need extra paperwork, as explained by U.S. Customs and Border Protection here https://www.tsa.gov/travel/security-screening/identification . Also, visit the U.S. State Department's website for passport services and information. Passengers NOT in possession of valid international travel documents for the destination country and transit points will be unable to travel, and the total trip cost could be forfeited.

Rules of past criminal offenses may be applicable when visiting a foreign country, both within or outside their boundaries. Whether you have a current or past offense, contact the country you intend to travel to directly for entry and exit requirements. SkyMed Travel believes it is an invasion of privacy for any of our staff members to make this inquiry to our customers/travelers. Travel documents, including, without limitation, airline tickets, hotel vouchers, tour vouchers, cruise ship documents, or any other documentation, whether in electronic form or otherwise, are used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and or restrictions such as, but not limited to, being non-refundable, non-date-changeable, and subject to cancellation and or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must match the name of the passport/photo identity holder. An incorrect name on a booking may result in an inability to use that booking and can cancel. Any errors in names, dates, flight numbers, and timings may result in the inability to use that booking and can result in cancelation. Any errors in names, dates, and or any timings on your documentation will be your responsibility if not advised at the time of booking. Airlines make schedule changes, so please reconfirm flight times and flight numbers at least 48 hours before your departure.


TRAVEL RISKS AND SAFETY


SkyMed Travel urges all travelers and customers to stay fully informed about the U.S. Government's advisories when traveling to a foreign country here https://travel.state.gov/content/passports/en/alertswarnings.html . In addition, customers/travelers must be aware of health concerns when traveling. The travelers' responsibility is to have the proper immunizations and the required documentation of such immunizations before travel. SkyMed Travel will not assume responsibility for the accuracy of health requirements, documentation requirements, and literature. Consult your health provider/doctor BEFORE booking.



HAZARDOUS MATERIALS


US Federal transportation rules prohibit traveling with hazardous materials. (1) U.S.A. federal law forbids the carriage of hazardous materials aboard aircraft in the passenger's luggage or on the passenger's person. A violation can result in five years' imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives, and radioactive materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals. (2) There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in the passenger's luggage and certain smoking materials carried on the passenger's person. For further information, each passenger should contact the relevant airline representative(s) on their itinerary. CREDIT CARD PAYMENTS TERMS

  • All credit cards must have verifiable U.S.A. or Canadian billing addresses. (All prices are based on the U.S. Dollar).

  • If there is an issue with the credit card, we will notify you within 24 hours. Submitting the credit card does not automatically guarantee purchase.

  • SkyMed Travel bears no responsibility in the event our suppliers and or SkyMed Travel do not charge your credit card. Several reasons for a credit card not being charged, such as but not limited to an airline rejected the booking, the fare increased after payment information was submitted, insufficient funds available, a security notification from the bank, etc.

  • SkyMed Travel uses stringent safety measures for credit card payment processing. Fraudulent transactions, if any, they are reported to the suppliers and other federal and state organizations.

  • You agree to be liable for any credit card payments disputes or other problems such as fraud made to us, the Supplier on behalf of you, or any individual you represent. In addition, you agree to reimburse SkyMed Travel in cases of fraud or chargebacks.

  • Credit card transactions over the phone to our Customer Service Department are recorded and are available as evidence in case of any dispute or for the legal form of evidence.

  • Online credit card transactions are authorized when a user or anyone acting on their behalf accepts these terms and conditions.

SkyMed Travel will deny or ask for further documentation for what we deem as a high-risk transaction such as, but not limited to, a one-way ticket between two foreign countries, a 3rd party credit card payment, certain specific destinations and originations, and high fare levels
Fares are not guaranteed until tickets and documents are issued.
Most airline fares and tickets are NON-REFUNDABLE.


If SKYMED TRAVEL and SkyMed International and any of its affiliates is the merchant on your credit card transaction, you agree to the following: SKYMED TRAVEL SkyMed International and any of its affiliates, services consist of facilitating the sale and paying the Suppliers, and once SKYMED TRAVEL SkyMed International and any of its affiliates provide said services, you agree not to dispute the credit card charge. If a Supplier does not provide the service or ceases operations, your only recourse will be against the Supplier. If a Supplier goes bankrupt, your only recourse will be to file a claim with the Supplier’s bankruptcy court.


TICKET PROCESSING ERRORS/ISSUES DISCLAIMER

SkyMed Travel is not responsible for any purchases that we cannot process due to any inaccurate and or incomplete verification of credit card information or due to other technical malfunction with our partner systems or our systems. If we are unable to contact you, we reserve the right to cancel your booking. An email will be sent advising you of the cancellation and will serve as the final notification. Please note, SkyMed Travel will not be responsible for any fare, tax, rate of exchange, or any other increases if you decide to rebook the itinerary.

BOOKING CONFIRMATION

It is the responsibility of the traveler and or the person booked on our website or made the booking directly with a customer service agent to review and reconfirm names, dates, itinerary, supplier name/s, routing, including any airport changes, are in accordance and acceptance of the traveler. If you discover any discrepancy in your reservation, you are requested to immediately contact a SkyMed Travel customer service agent within 2 hours from the time of the booking. If we do not hear from you within 2 hours of completing the booking, we shall consider the booking you have made to be acceptable to you.

AUTHORITY TO SEND COMMUNICATION

By approving this transaction, you are authorizing SkyMed Travel to send you communications in the form of email, postal mail, instant messaging, phone call, and any other form of electronic or paper communication. These communications will be primarily for customer service and marketing materials. In addition, SkyMed Travel may share your contact and flight information with the Supplier for them, in the unlikelihood, to contact you for anything regarding the booking made through them.


NOTICE ON AIRCRAFT CABIN INSECTICIDE TREATMENT

Description of Site and License

The Site provides information about SkyMed Travel's products and services. SkyMed Travel protects all text, images, and other contents of the Site (collectively, the "Contents") by the copyright laws of the United States and other countries. SkyMed Travel grants you a license to view the Contents on the publicly accessible areas of the Site. The granted license does not include any right to screen scrape, reproduce, distribute, broadcast, modify, or otherwise commercially exploit any of the Contents, except that reproduction incidental to your use of the Site under these Terms is permitted. SkyMed travel can terminate such granted license at any time with or without cause.

Modifications to Site

SkyMed Travel at any time reserves the right to modify the Contents or discontinue providing access to the Site (or any part thereof), temporarily or permanently, with or without notice to you. You agree that SkyMed Travel will not be liable to you for any modification, suspension, or discontinuance of the Site or the Contents.

Termination of Your Access

You agree that SkyMed Travel, in its sole discretion, may terminate your access to or use of the Site for any reason, including, without limitation, our belief that you have violated or acted inconsistently with the letter or spirit of these Terms. You agree that any termination of your access to the Site under any provision of these Terms may occur without prior notice to you, and you also agree that SkyMed Travel will not be liable to you for any termination of your access to the Site.

You agree that you are solely responsible for obtaining and maintaining any equipment and services needed to access and use the Site and all charges related to that.

Restrictions on Your Use of the Site

SkyMed Travel will take action to prevent the misuse of the Site for any unlawful or objectionable purpose. Accordingly, you agree not to use the Site for any questionable or illegal purpose, including without limitation, use of the Site to post, upload or transmit any Content that is:
(1) Unlawful under the laws of any jurisdiction to which you or SkyMed Travel Company are subject. (2) Harmful, threatening, harassing, defamatory, invasive of the privacy of another, or obscene, including without limitation any images or depictions of child abuse, child pornography, or minors engaged in sexual conduct or explicitly sexual situations.
(3) Insider information or any other proprietary or confidential information.
(4) Infringement of any patent, trademark, trade secret, copyright, or other intellectual property rights.
(5) Falsified, including without limitation the use of forged headers or otherwise manipulated identifiers in order to disguise its origin.
(6) Containing or transmitting software viruses or any other malicious computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software.
(7) To be used in any passenger rights claims actions.
(8) An advertisement or solicitation for any products or services.

You agree to indemnify and hold harmless SkyMed travel from any liability incurred due to your violation of these Terms.

Disclaimer of Warranties and Limitation of Liability

YOU AGREE THE SITE AND CONTENTS THAT ARE PROVIDED TO YOU "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SkyMed Travel does not warrant that the Site will be available at any given time, secure, or free of error. You use the Site at your own risk, and you assume the risk that any material downloaded by you from the Site may cause loss of data or damage to your computer system.

YOU UNDERSTAND AND AGREE IN NO EVENT WILL SKYMED TRAVEL BE LIABLE TO YOU FOR ANY DIRECT OR INDIRECT DAMAGES, EVEN IF SKYMED TRAVEL IS AWARE OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS OR FOR ANY OTHER SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR INCIDENTAL DAMAGES, HOWEVER CAUSED, WHETHER BASED UPON CONTRACT, NEGLIGENCE, STRICT LIABILITY IN TORT, WARRANTY, OR ANY OTHER LEGAL THEORY.

Indemnification

You agree to indemnify, defend and hold harmless SkyMed Travel and its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorney fees, resulting from any violation of these Terms, or any negligent or wrongful activity related to the use of the Site, by you or any other person accessing the Site using your account.

SkyMed Travel and SkyMedTravel.com are registered trademarks of SkyMed International, Inc. All rights reserved. All other trademarks appearing on the Site are the property of their respective owners.

Choice of Law & Forum Selection

The construction, validity, and performance of these Terms and any disputes between the parties shall be governed by and construed according to the laws of the State of Arizona, without giving effect to its conflicts of law principles and any federal laws applicable therein. Both parties submit to the exclusive jurisdiction of the courts of the State of Arizona concerning any legal proceedings relating to these Terms.

No Third-Party Beneficiaries

These Terms create no third-party rights or obligations between SkyMed Travel and any other person. It is understood and agreed that the parties do not intend that any third party should be a beneficiary of these Terms.

Severability & Waiver

The invalidity of any term or provision of these Terms will not affect the validity of any other provision. A waiver by SkyMed Travel of strict performances of any provision of these Terms will not be a waiver of or prejudice SkyMed Travel's right to require strict performance of the same provision in the future or of any other provision of these Terms.

Entire Agreement

These Terms constitute the entire agreement between the parties, and there are no promises, terms, conditions, or obligations between the parties other than those contained in these Terms.
